"Red flag" laws, also known as Extreme Risk Protection Orders (ERPOs), are a contentious issue, especially from a conservative viewpoint that prioritizes Second Amendment rights.

These laws enable petitions for the temporary removal of firearms from individuals deemed a risk to themselves or others. As of June 2023, more states have adopted them. California, Colorado, Connecticut, and over 20 others, including Washington allow various parties, including law enforcement and family members, to petition a judge who then decides on the order.

The process involves both emergency and final orders, with the latter lasting up to a year and subject to renewal. Critics argue these laws infringe on personal liberties. Despite constitutional challenges, courts have mostly upheld these laws.

The debate centers on balancing public safety with constitutional rights.
