In the case of Tamer Mahmoud v. Monica B. McKnight, parents attempted to restore a policy by the Montgomery County Public Schools (MCPS) that would permit them to exempt their children from reading and discussing books featuring LGBTQ+ characters in elementary schools. They claimed that the material in these books was indoctrinatory and infringed upon their religious beliefs.
However, the court, led by Judge Deborah L. Boardman, a Biden appointee, did not uphold the parents' argument. Judge Boardman determined that the parents' claimed right to direct their children's education by avoiding public-school curriculum conflicting with their religious views is not a fundamental right under due process.
Consequently, the judge rejected the parents' plea for a preliminary injunction that would have allowed them to opt their children out of this part of the curriculum when the school year commenced on August 28.
